Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HomeNavi Finance dashboard (the "Service"), operated by TM & KS Partners LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is a financial reporting and tracking dashboard for marketing agencies. It connects to third-party advertising, CRM, and payment platforms that you authorize (Meta, GoHighLevel, and Whop) and consolidates data from them to display revenue, expenses, profit, amounts owed, appointment metrics, and advertising performance.

• You are responsible for keeping your API tokens, credentials, and login information secure and confidential.
• You are responsible for the accuracy of the client data, rates, and mappings you enter into the Service.
• You must have the authority to connect and access the third-party accounts you link, and to use any data those accounts contain.
• You agree to use the Service only for lawful purposes and in compliance with the terms of the third-party platforms you connect.

The Service accesses third-party platforms on your behalf using the credentials and tokens you provide. Your use of those platforms remains subject to their respective terms and policies. We access data on a read-only basis where applicable and do not control the availability, accuracy, or continuity of any third-party API.

Data displayed in the Service is derived from third-party APIs (Meta, GoHighLevel, Whop) and from information you enter. We do not warrant that any figure, metric, or calculation is accurate, complete, or current. Third-party APIs may return delayed, incomplete, or incorrect data, and reported figures may lag behind real-time activity. You should not rely on the Service as your sole source of truth for financial, tax, accounting, or business decisions. The Service is provided for informational purposes only and does not constitute financial, accounting, or legal advice.

The Service is provided as an internal tool. No fees are charged for use of the Service under these Terms. If paid plans are introduced in the future, applicable pricing and payment terms will be provided separately.

You may not misuse the Service, attempt to gain unauthorized access to it or to any connected account, interfere with its operation, or use it in violation of applicable law or third-party platform terms. We may suspend or terminate your access to the Service at any time, with or without notice, for misuse or violation of these Terms.

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied. In no event will TM & KS Partners LLC or its members be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of (or inability to use) the Service, including any reliance on data obtained through third-party APIs. Our total aggregate liability for any claim relating to the Service will not exceed one hundred U.S. dollars (USD $100).

You agree to indemnify and hold harmless TM & KS Partners LLC from any claims, damages, or expenses arising out of your use of the Service, your data, or your violation of these Terms or of any third-party platform's terms.

We may update these Terms from time to time. Material changes will be reflected by an updated effective date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.
